Formation of a contract and terms of delivery

These Delivery and Payment Terms apply to orders placed through our online shop at www.janinagold.com/shop.

Our General Terms and Conditions (GTC), Right of Withdrawal Policy and, for digital sewing patterns, the applicable Sewing Pattern Licence Terms also apply.

 
1. Prices

The prices displayed in the online shop at the time the order is placed apply.

All prices shown are total prices.

The treatment of VAT is governed by the applicable statutory provisions.

No shipping costs apply to digital products.

For physical products, any additional shipping costs will be displayed before the order is completed.

 
2. Payment Methods

The payment methods available for the respective order will be displayed during the checkout process.

These may include, in particular:

  • credit card;

  • PayPal;

  • direct debit; and

  • other payment methods processed via Stripe.

The payment methods actually available for a particular order are those displayed during checkout.

Unless otherwise stated for the respective payment method, the purchase price is generally due upon conclusion of the contract.

 
3. Digital Products

Digital products, including digital sewing patterns and e-books, are provided exclusively in electronic form unless expressly stated otherwise in the respective product description.

When purchasing a digital product, no physical product will therefore be sent by post or delivery service.

Digital products are provided in particular by means of a download link, download page or comparable electronic method.

Unless otherwise stated, digital products are made available after successful completion of the ordering and payment process.

For digital content made available for immediate download following purchase, the statutory provisions concerning the right of withdrawal and its possible expiry once performance begins also apply. Further details are set out in our Right of Withdrawal Policy.

 
4. Technical Issues with Digital Downloads

If a digital product cannot be made available immediately due to a temporary technical issue, please contact us at hello@janinagold.com.

We will review the issue and, where appropriate, provide an alternative means of accessing the digital product you purchased.

Your statutory rights in the event that digital content is not provided or is not provided in conformity with the contract remain unaffected.

 
5. Delivery of Physical Products

Physical products will be shipped to the delivery address provided by the customer during the ordering process.

The shipping costs and any applicable delivery restrictions for the respective product will be displayed in the online shop and/or during checkout.

The expected delivery time is stated in the respective product description.

For products that are immediately available, processing generally begins after successful receipt or confirmation of payment.

 
6. Pre-Order and Made-to-Order Products

Certain garments, headpieces, accessories and other physical products may be offered as Pre-Order or Made-to-Order products.

For these products, production begins only after the order has been placed or after the end of the respective Pre-Order period.

The expected production and/or delivery time will be stated in the respective product description.

Please note that the overall delivery time for such products may consist of the stated production time plus the subsequent shipping time.

If a material delay occurs, we will inform you accordingly. Your statutory rights remain unaffected.

The fact that a product is manufactured only after an order has been placed does not automatically mean that the statutory right of withdrawal is excluded.

However, statutory exceptions to the right of withdrawal may apply to products made individually according to your personal measurements or other individual specifications. Further details are set out in our Right of Withdrawal Policy.

 
7. Shipping Costs

The shipping costs applicable to the respective order will be displayed before the order is completed.

No shipping costs apply to products supplied exclusively in digital form.

For orders containing both digital and physical products, shipping costs may apply to the physical products included in the order.

 
8. Deliveries Outside the European Union

Deliveries of physical products to countries outside the European Union may be subject to additional customs duties, import VAT, import fees or other charges.

Where such charges are not collected or paid by us, they may be payable by the customer directly to the relevant authorities or service providers.

The amount of and requirements for such charges are determined by the laws and regulations of the respective destination country.

 
9. Unavailability of Physical Products

If, in exceptional circumstances, an ordered physical product is unavailable or cannot be manufactured or delivered, we will inform you without undue delay.

Where payment has already been made and delivery is not owed or is no longer possible, payments already made will be reimbursed in accordance with the applicable statutory provisions.

Your statutory rights remain unaffected.

 
10. Conclusion of Contract

Details regarding the conclusion of the contract, order confirmation and the storage and provision of contractual terms are set out in our General Terms and Conditions (GTC).

Before submitting your binding order, you will have the opportunity to review the information entered and the products selected and to make corrections where necessary.

The order is submitted in a binding manner using a button or similar function that clearly indicates that placing the order entails an obligation to pay.

After we receive your order, you will receive an electronic confirmation.

11. Withdrawal and Returns

Information regarding the statutory right of withdrawal, the return of physical goods, possible liability for loss in value resulting from handling beyond what is necessary to inspect the goods, and the special rules applicable to digital content and individually customised products can be found in our Right of Withdrawal Policy.

 
12. Statutory Rights

Your statutory rights in the event of non-delivery, failure to provide digital content, defective products or other breaches of contract remain unaffected by these Delivery and Payment Terms.
